Overview

Welcome to HESACO. The terms “we,” “us,” and “our” refer to HESACO. HESACO operates this store and website, including the related information, content, features, tools, products, and services made available to you (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with the policies referenced in them (the “Terms”), describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using the Services, or by placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Access and Accounts

You must be at least the age of majority in your state, province, or country of residence, or use the Services with the involvement and consent of a parent or legal guardian where permitted by law.

You agree that the email address, billing information, payment information, shipping information, and other details you provide are accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

2. Products and Product Information

We aim to present product descriptions, measurements, colors, materials, and images accurately. Screen settings, lighting, production batches, fabric characteristics, and measurement methods may cause reasonable differences. These differences do not limit any rights relating to products that are faulty, damaged, or materially different from their description.

Product descriptions, availability, and prices may change without notice. We may discontinue a product or limit the quantity available to a person, household, geographic region, or jurisdiction where reasonably necessary.

3. Orders and Acceptance

Submitting an order is an offer to purchase. An order confirmation acknowledges receipt of your order but does not necessarily constitute acceptance. Your order is accepted when we confirm acceptance or begin fulfillment, subject to applicable law.

We may refuse, limit, or cancel an order before fulfillment for reasons including suspected fraud, payment failure, inventory error, pricing error, shipping restrictions, unauthorized resale, or a material violation of these Terms. If we cancel a paid order, we will return the applicable amount to the original payment method.

Review your order carefully before submitting it. Contact us immediately if you need to request a change or cancellation. We cannot guarantee changes after fulfillment has started. Purchases are subject to our Return Policy.

4. Prices, Currency, and Billing

Prices, discounts, and promotions may change without notice. The price charged will be the price shown at checkout when the order is submitted, subject to correction of obvious errors and applicable law. Unless expressly stated otherwise, displayed product prices do not include shipping, customs duties, brokerage charges, or other import charges.

You agree to provide current, complete, and accurate purchase and payment information. You represent that you are authorized to use the payment method provided and agree to pay all charges shown at checkout.

Promotions may be governed by additional terms. If promotional terms conflict with these Terms, the promotional terms apply to that promotion.

5. Shipping and Delivery

Shipping services, charges, delivery estimates, customs information, and delivery procedures are described in our Shipping Policy. Delivery dates are estimates unless applicable law requires otherwise.

We are not responsible for delays caused by carriers, customs authorities, severe weather, incorrect addresses, or events outside our reasonable control. Responsibility for loss or damage transfers only at the time and in the manner permitted by the consumer laws applicable to the order.

6. Returns and Refunds

Returns, exclusions, exchanges, and refunds are governed by our Return Policy. Nothing in these Terms or our policies excludes or limits rights that cannot lawfully be excluded.

7. Intellectual Property

The Services, including HESACO names, logos, branding, text, product descriptions, photographs, graphics, video, audio, layout, and design, are owned by or licensed to HESACO and are protected by applicable intellectual-property laws.

You may use the Services only for personal, non-commercial shopping purposes. Except where permitted by law, you may not reproduce, distribute, modify, publicly display, republish, download, scrape, store, transmit, or commercially exploit our content without prior written permission. Shopify and other third-party names and marks remain the property of their respective owners.

8. Optional Tools and Third-Party Links

We may provide access to tools, integrations, content, or websites operated by third parties. We do not control those services and provide access to them on an “as available” basis. Your use of third-party services may be governed by separate terms and privacy policies.

We are not responsible for third-party websites or for products and services purchased directly from third parties. Review their terms and policies before completing a transaction.

9. Relationship with Shopify

HESACO is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are made directly from HESACO. Shopify is not the seller of HESACO products and is not responsible for the fulfillment, quality, safety, or legality of those products, except to the extent Shopify separately agrees or applicable law requires.

10. Privacy

Personal information collected through the Services is handled according to our Privacy Policy. Because the Services are hosted by Shopify, Shopify and service providers acting on our behalf may process information in other countries as necessary to operate, secure, analyze, and improve the Services.

11. Reviews and Feedback

If you submit a review, photograph, suggestion, idea, or other feedback, you grant HESACO a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and display that content for operating and promoting the Services, subject to applicable privacy and consumer laws.

You represent that you have the rights necessary to submit the content, that it is accurate to the best of your knowledge, and that you have disclosed any compensation or incentive connected with it. Feedback must not infringe another person’s rights or contain unlawful, abusive, deceptive, or malicious material.

12. Errors and Corrections

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability. We may correct or update information and, where reasonably necessary, cancel an affected order. If a paid order is cancelled, we will refund the applicable amount.

submit false, fraudulent, abusive, defamatory, or misleading information;
introduce malware or interfere with the security or operation of the Services;

You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary to protect the Services, customers, HESACO, Shopify, or third parties, or to respond to a material violation of these Terms. Provisions that by their nature should survive termination will remain effective.

15. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided on an “as available” basis. We do not guarantee that access will always be uninterrupted, timely, secure, or error-free.

Nothing in these Terms excludes any warranty, consumer guarantee, or other right that cannot lawfully be excluded. Any disclaimer applies only to the extent permitted in your jurisdiction.

16. Limitation of Liability

To the maximum extent permitted by law, HESACO and its service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Services or products purchased through them. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law.

Nothing in these Terms limits liability for fraud, willful misconduct, death or personal injury caused by negligence where such liability cannot be limited, or any consumer right or remedy that cannot lawfully be excluded.

17. Indemnification

To the extent permitted by law, you agree to indemnify HESACO against third-party claims and reasonable costs resulting directly from your unlawful misuse of the Services, your infringement of another person’s rights, or your material breach of these Terms.

18. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.

19. Waiver and Entire Agreement

A failure to enforce a provision is not a waiver of that provision. These Terms and the policies referenced in them form the agreement between you and HESACO regarding the Services and replace prior communications concerning the same subject matter.

20. Assignment

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a reorganization, financing, merger, acquisition, sale of assets, or transfer of the business, subject to applicable law.

21. Governing Law

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law principles. This choice of law does not deprive a consumer of mandatory protections available under the laws of the consumer’s habitual country or region of residence.

22. Changes to These Terms

We may update these Terms by posting a revised version on this page. The date at the top indicates the latest revision. Material changes will be communicated where required by law. Changes apply prospectively unless applicable law requires otherwise.
